Hc Seeks Affidavit On Status Of Survey, ET RealEstate

NAVI MUMBAI: The Bombay high court on August 18 directed Cidco, Navi Mumbai Municipal Corporation and MIDC to file an affidavit within two weeks on the status of the survey of illegal constructions in the city. The bench was hearing a contempt petition filed by activist Rajeev Mishra for non-compliances.

The high court had, in November 2018, directed the agencies to submit a report by taking the help of revenue and survey department employees within a year.

The petitioner’s counsel, advocate Priscilla Samuel, had drawn attention of the HC that four years had elapsed but the survey had not been completed. The state government has stated that the order has been challenged in the Supreme Court, which in turn on November 13, 2019 directed status quo regarding one of the 10 high court directions pertaining to demolition of a few buildings.

Samuel told the HC that nine other directions have not been stayed by the Supreme Court. Hence the authorities are under legal obligation to have completed the survey work within a year as per the high court order.

The counsel for the three government agencies have told the bench that survey work has started in their respective jurisdiction but yet to be completed.

Activist Rajeev Mishra alleged: “The three government agencies have deliberately delayed the exercise, which in turn serves proliferation of illegal constructions in the city.”
