Recovery Of Penalties Low, Orera Tells Hc, Real Estate News, ET RealEstate

CUTTACK: The Odisha Real Estate Regulatory Authority (ORERA) on Monday conceded in the Orissa high court that there has been negligible recovery of penalty in execution of ORERA’s orders for realisation of money in disputes related to delivery of possession and handover of flats to consumers.

The affidavit was filed in reply to a PIL seeking intervention against ORERA sending its orders imposing the penalty to the civil courts for execution. In the process recovery of the penalty has been negligible, according to the petition. Bimalendu Pradhan, a Bhubaneswar-based flat owner filed the petition.

Taking on record the submission of the affidavit by ORERA’s counsel Bibhu Prasad Tripathy, the two-judge bench of Chief Justice Subhasis Talapatra and Savitri Ratho posted the matter to September 13 for consideration, while expecting petitioner counsel Mohit Agarwal to submit rejoinder, if any by then.

In the affidavit, ORERA secretary Bijay Kumar Prusty said it is a fact that substantial recovery has not been made. While Rs 19.87 crore has been imposed as penalty in 153 cases, only Rs 40 lakh has been realised. The ORERA orders in the disposed of execution cases involving realization of money are being sent to the district authorities.

“Steps are being taken to expedite the process of realisation of money,” he stated.
