Nod To ‘conditional’ Construction On Pvt Land In Shimla’s Green Areas, ET RealEstate

SHIMLA: Himachal Pradesh has finally notified the Draft Shimla Development Plan 2041, but the same would be implemented after a month as per the directions of the Supreme Court. Considering the demands of city residents not to ban construction in green areas, the development plan has permitted the construction, provided it doesn’t harm the ecology.

The plan has held the grievance of the Shimla residents as genuine and has permitted construction on privately-owned, open land here; but no cutting and felling of trees would be allowed and construction permission will solely be given for sandwiched plots and barren land, only for residential purposes.

The Supreme Court, through an order on May 3, had directed the Himachal Pradesh government to consider the objections to the draft plan, and publish the final plan within six weeks. The apex court had clarified that once the final development plan is published, it would not come to effect for at least one month from the date of its publication.

At present, as per National Remote Sensing Centre (NRSC) base-map land-use, 10,662 hectares of land is under forest, tree-clad and plantation areas in the city, which includes government as well as private land.

The approved development plan states that minimum and limited construction may be allowed on vacant and sandwiched plots within the 26 hectares (6.28%) of private open land, but more strategies should be adopted to preserve these forests areas, which form 10,662 hectares (43.27%) of land in the total planning area in Shimla.

During the stakeholder meeting of Shimla municipal corporation (MC), the councillors had pointed out that before notification of green belts on December 7, 2000, buildings were already constructed in these green pockets.

However, some of the residents with land in the green area could not construct their houses because of financial incapacity, and their plots lie sandwiched between built-up areas.
