SHIMLA: The state government has amended the Himachal Pradesh Town and Country Planning Rules, 2014, and issued the gazette notification for the Himachal Pradesh Town and Country Planning (Ninth Amendment) Rules, 2023, wherein residents of state have been allowed to regularise their habitable attic floors by paying the fees payable under rule 16(2) for cases which involve premium floor area ratio (FAR) upto 0.25.

The draft notification to carry out amendments was notified on May 31 and published in the gazette on June 3 for inviting objections and suggestions from the persons likely to be affected. After receiving the objections and suggestions within the stipulated period and duly considering them, the amendment has been made.

According to the notification issued by principal secretary (TCP) Devesh Kumar, the area projection for below portion of roof of residential building having height 2.1 m or more (in sqm) will be Rs 50,000 for up to 40 sqm, Rs 75,000 for 40-60 sqm, Rs 1 lakh for 60-100 sqm and Rs 1,000 per sqm for more than 100 sqm. The rates for uses other than residential, including real estate projects, will be 1.6 times of the above rates.

New rules say that notwithstanding anything contained under the general regulations of any development plan/interim development plan for the time being in force, as applicable in respect of any planning or special area notified under the statutory provisions of the Himachal Pradesh Town & Country Planning Act, 1977, the attic will be permissible for habitable use.

Premium FAR of 0.25 will be permissible for habitable attic for which additional fee as prescribed under rule 16(3) shall be payable. However, the attic will be within the maximum permissible height of the building as provided under such regulations of development plan/interim development plan as the case may be.

It said that wherever a habitable attic is proposed, height of sloping roof at eaves may vary from zero to 0.75 m and maximum height of ridge at the centre shall be flexible subject to maximum permissible height of the building. In case of habitable attic, only the area with clear height of 2.1 meters shall be counted towards FAR. It said that the option of habitable attic will be available for residential and all other uses and separate fee will be charged for habitable attic in each block. The habitable basement will be counted as an independent storey, it added.
