Hc Orders Bmc To Demolish Unauthorised Sector V Building, Real Estate News, ET RealEstate
KOLKATA: Calcutta High Court on Monday directed the Bidhannagar Municipal Corporation (BMC) to raze an unauthorized construction at Shantinagar, Salt Lake Sector V, by 1pm and sever power and water connections to the building. The court directed the corporation to submit an action taken report (ATR) on Tuesday.
Justice Abhijit Gangopadhyay passed the demolition order after the builder of the unauthorized construction didn’t comply with the court directive asking him to appear before the court. The counsel for the Bidhannagar Municipal Corporation submitted to the court that the builder hadn’t appeared for hearing at the corporation despite a notice.
The court granted liberty to the residents of the building at 181 Shantinagar to come to court, seeking rehabilitation.
Petitioner Panchibala Poley had moved the high court after the Bidhannagar Municipal Corporation didn’t take steps following the petitioner’s complaint to the corporation.
After the HC order, a team consisting BMC officials, demolition workers and police went to the spot to start the demolition work but faced local resistance.
BMC officials said that earlier, too, teams were sent to demolish two such buildings identified as illegal construction but they could not raze the buildings following strong resistance from locals.
The civic authorities had previously sent a letter to the North 24 Parganas district magistrate, seeking help for evacuation of residents of the identified unauthorised buildings one after another and also sent a letter to the police requesting for assistance for them to undertake the demolition drive.
Earlier this year, the civic authorities had sent self-evacuation and demolition notices to developers of 322 unauthorised buildings, but officials said that the instructions were not followed.
