State Igr To Check All Docus From 2020-22 For Rule Breach, Real Estate News, ET RealEstate

PUNE: The state office of the Inspector General of Registration and Controller of Stamps (IGR) has sought review of all property registrations carried out between 2020 and 2022 to address rising complaints about violation of various laws governing the real estate sector in Maharashtra.

Officials from the property registration department told TOI that committees have been formed to check property documents at all the 519 offices across the state to rule out violations of the Real Estate (Regulation and Development) Act (RERA), 2016, and the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947.

RERA registration is mandatory for every realtor wanting to develop residential or commercial property on an area of more than 500sqm or the number of proposed apartments in all phases is more than eight. There is a ban on registration of fragmented and small pieces of land under the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act of 1947. According to the department of Maharashtra IGR, only the land size of 11 gunthas/ 11,000sqft or more can be registered.

Around 25-30 lakh documents are registered with the state department every year. “All the documents registered in the last three years will be checked and a detailed report will be submitted to the government in a year,” a senior property registration department official.

State IGR H Sonawane told TOI that it was a massive task and the review would be carried out simultaneously with the day-to-day work.

Earlier, checks were carried out at some property offices in the state, following which a report was suspended leading to inquiry and suspension of some officials

A total of 82 officials from the state property registration department are already under scanner for illegally registering documents in violation of RERA and the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, a registration department official said. Of these 82 officials, 44 were from the Pune district, while the remaining were from Thane and Aurangabad, the official said.
