No decision yet on MOFA repeal, says deputy Maharashtra CM, Real Estate News, ET RealEstate

PUNE: Deputy chief minister Devendra Fadnavis said on Thursday that the state government had so far not decided to repeal the Maharashtra Ownership of Flats Act (MOFA), 1963.

While developers’ bodies have demanded that the Act should be repealed, many citizens and even the cooperation department have said that the Act should continue. Consumer groups had sent out several representations to the housing department opposing the move to repeal MOFA.

When asked the question, Fadnavis, who is also in charge of the state housing department, told TOI: “No decision as yet.”

Housing department officials also confirmed that they are yet to decide as they have not yet discussed the matter with all stakeholders.

Consumer groups recently sent out new representations hoping that the government does not make any new announcement on the Act ahead of local polls or general elections.

Ramesh Prabhu, the chairman of Maharashtra Societies Welfare Association, has submitted his appeal both to the cooperation department and the housing department to not repeal the Act.

“If MOFA is repealed, it will be gross injustice to housing societies in which crores of people live. Projects not registered under RERA are governed by MOFA. From 1963 till the implementation of RERA, lakhs of buildings were constructed under MOFA. If it is is repealed, all protections available to such buildings and also new buildings not covered under RERA will be deprived of the benefits and protection provided under the Act,” he said.

Credai vice president Sunil Furde told TOI there is a need to repeal MOFA because RERA is in place, which covers all aspects of construction. If anything is missing in the Act, it can be amended after discussion, he said.
