NAVI MUMBAI: Judicial magistrate NR Indalkar on Wednesday remanded Mumbai-based builder Suresh Bhatade to judicial custody in a cheating case for illegally selling six flats of Pioneer CHS, Panvel, worth Rs 4.3 crore.

Meanwhile, additional sessions judge KG Paldwar on Thursday dismissed the anticipatory bail pleas of two other builders including a retired assistant commissioner, income tax Sunita Joshi, and another Mumbai-based builder Bhavesh Jain.

Last Friday, the Panvel City police had arrested Bhatade who was absconding for over two months. Bhatade, Jain, Joshi and another builder have been booked by the Panvel City police in August this year following complaints by the Pioneer CHS after six of their 10 flats (as part of redevelopment benefit) were illegally sold and registered without their knowledge.

The CHS and Akshay Developers had entered into a redevelopment agreement in September 2012 and an additional supplementary agreement in October 2015. Pioneer CHS treasurer Gangaram Samant had lodged a police complaint against the builders selling out six apartments (five 2-BHKs and one 1-BHK) without obtaining any permission in July 2022 and March 2023.

The Pioneer CHS and the builders had obtained building plan permission from the erstwhile Panvel municipal council for a ground plus seven-storey residential-cum-commercial building. In December 2015, they obtained a revised building permission for ground plus 12-storey residential-cum-commercial building. However, there were issues with regards to transfer of development rights (TDR) and other non-compliance issues.

Pioneer CHS had in September 2012 entered into a redevelopment agreement with Akshay Developers, Panvel, Sunita Joshi and late Nirmala Shah as partners. The redevelopment work started in 2014. Joshi and Shah had entered into a partnership agreement with Bhatade and Jain.

The Pioneer CHS had 46 flats earlier. Post redevelopment, the building has become a ground plus 12-storey high rise with 96 flats and nine shops. As per the supplementary agreement signed between Pioneer CHS and Akshay Developers in October 2015, the Pioneer CHS will have 10 more flats.

After the formation of PCMC on October 1, 2016, the goof ups in the approval were detected. Seven illegal occupants were served with notices under Maharashtra Regional Town Planning Act (MRTP) in December 2017. The builders gave possessions by breaking the rules of redevelopment works such as without obtaining occupancy certificates..
