Man Waiting 10 Years For Flat Dies, Fir Against 2 Developers, Real Estate News, ET RealEstate

GHAZIABAD: In 2012, Brijmohan Goyal invested in a flat at a society in Raj Nagar Extension. Since then, the area has developed into a bustling housing hub, now connected to Delhi by the Hindon Elevated Road, but Goyal’s flat at the Star Rameshwaram society never took shape.

This week, his son Sanchit (30) approached the city police, saying his father had paid Rs 26 lakh of the 2BHK-flat’s total cost of Rs 32 lakh, but the house that was due for possession in 2017 was far from completion.

Brijmohan, who ran a cloth shop in Agra, died last year, leaving the fight for the flat’s possession to Sanchit. The 30-year-old told TOI on Tuesday that his father’s dream to gift the flat to his younger sister on her marriage “went into the trash”.

Police said an FIR was registered against the society’s developer and the case has been forwarded to the anti-fraud cell for investigation.

“My father had booked the flat in 2012 to give it to my younger sister after her marriage. He paid Rs 6 lakh as the booking cost, and later took a loan of Rs 20 lakh for the remaining cost. The developer had promised to deliver the flat by November 2017. That year, the builder asked for more time from my father who told them my sister’s marriage was scheduled in 2018. They then promised to give the flat by February 2018,” Sanchit said.

He added: “Years went by and my father went to every possible official of the builder, but everyone made false promises to him. We feel cheated. I’ve paid back Rs 13 lakh of the loan, and I am still paying EMIs…”

Sanchit said he went to the police as he had “promised” his father he would get the flat for his sister. “Just 45% of the society’s work has been completed in over a decade,” he said.

Ghaziabad DCP Nipurn Agarwal said an FIR was registered against the developers, Nitin Gupta and Goldy Gupta.

“On the basis of the complaint at the Nandgram police station, we have registered an FIR under IPC sections 420 (cheating) and 406 (punishment for committing criminal breach of trust). An investigation is under way and further action will be taken after the investigation,” he said.

The developer and officials of Star Rameshwaram did not respond to requests for comment till Tuesday evening.
