Independent agency should probe ‘graft’ in Noida authority: SC, ET RealEstate

September 16, 2023

NEW DELHI: Observing that many officials of Noida authority appear to be involved in allegedly siphoning of crores of public money by wrongfully sanctioning excess compensation in land acquisition cases over the years, the Supreme Court has favoured that a comprehensive probe be done by an independent agency.

A bench of Justices Surya Kant and Dipankar Datta said that there were numerous instances of such corruption and the authority had himself admitted it on affidavit but probe was not being done properly.

During the course of hearing, it transpires that the reported case is not the sole instance and there are numerous cases in which the New Okhla Industrial Development Authority (for short, ‘the Authority’) has paid compensation to the land owners, without any entitlement in law, prima facie for extraneous considerations.

“In our considered view, it cannot be done at the instance of one or two officers of the Authority. Prima facie, the entire Noida set up appears to be involved. In such circumstances, it appears to us necessary to refer the matter to some independent agency for a deeper probe and to unearth the truth,” the bench said.

The Supreme Court sought response from the Uttar Pradesh government on the issue and posted the case for hearing to October 5.

The court was hearing the bail plea of one of the accused in the case.
