NAGPUR: Dismissing a builder’s plea, the Nagpur bench of Bombay high court asked her to surrender before the district consumer forum within two months and undergo six months imprisonment to which she had been sentenced earlier, for failing to provide facilities promised to the customers at a layout.
As the petitioner firm KB Associates, through partner Rohini Band, failed to comply with its order of providing the facilities as promised, the consumer forum on June 21, 2022, had allowed execution proceedings filed by respondent Arti Kelkar and sentenced the builder to six-month jail along with ₹25,000 fine.
The firm challenged the forum’s order at the State Consumer Dispute Redressal Commission, but it refused to stay or suspend the order.
The builder was detained, but she approached HC and got interim relief. Later, HC quashed the interim relief and sent the case to the state commission for reconsideration.
