Cmda Locks And Seals Part Of Building In T Nagar, Real Estate News, ET RealEstate
CHENNAI: The enforcement wing of the Chennai Metropolitan Development Authority (CMDA) on Wednesday locked and sealed part of a commercial building on Usman Road in T Nagar that was constructed without obtaining permission. The building has six shops including one run by the government.
An unauthorized construction of the building having a basement, ground floor, mezzanine floor plus four floors and a 5th floor at old no. 94, new door no.162, Usman Road, T Nagar, is one of the commercial buildings covered in T Nagar survey report prepared by GCC and CMDA.
Earlier, the CMDA had issued a notice to the owner of the building asking to furnish the approved plan within three days from the date of receipt of the notice.
As he did not furnish it, a notice was issued for locking and sealing and removal of unauthorized development in 2011 with a specific request to discontinue the usage of the building and restore the land to its original position within 30 days from the date of the notice.
The owner of the building had submitted a regularization application in scheme 1999 and said application was rejected since the owner of the building did not furnish evidence to prove the construction was completed prior to 1999.
Subsequently, the owner filed a writ petition and got a stay against any enforcement action on the building.
The government passed an order for the regularization of part of the building only after demolition of the unauthorized portion. And, in the event of failure the enforcement action has to be taken by the competent authority.
Since the owner failed to restore the building and in continuation of this the de-occupation notice was issued, the premises were locked and sealed on Wednesday.
