Cheating case against GCON builder for failing to deliver premium amenities to buyer, ET RealEstate

VISAKHAPATNAM: An Army officer’s widow filed a cheating and criminal intimidation case against Gottumukkala Satyanarayana Raju and Gottumukkala Sivaram promoters of a private real estate company (GCON BUILDER) with Three-Town police in Vizag city.

The 62-year-old widow Chetti Lakshmi Bhai reported that a duplex flat that her son bought from GCON Builder was deficient in premium amenities.

She told the police that her elder son Ch Jagan purchased one residential duplex flat in October 2018 from Gottumukkala Satayanarayana Raju and Gottumukkala Sivaram. The builder promised that the project will be completed in 2019. However, they failed to complete the project and hand over the flat to Jagan on time.

The builder did not inform any cause for delay and extended the date of possession to July 2020. As per the registered sale deed document, the overall area of the flat is around 2,884 sq ft, including the carpet area (net usable area) of 1,997 sft.

Suspecting that the carpet area of the flat is less, she hired a licensed architect, who mentioned that the carpet area was 1,785.72sft. When the woman along with her son asked the builder to clarify the deficiency of service and cheating, the builder along with his manager Murali K Nipani threatened them with dire consequences.

Sub-inspector of Three-Town police station, S Santosh Kumar said that they have registered a case against GCON Builder under Sections 420 and 506 r/w 34 of IPC. We will examine the documentary evidence for further investigation into the case, he added.
