AHMEDABAD: The Gandhinagar District Consumer Dispute Redressal Commission ordered the Central Bank of India to pay a client Rs 2.50 lakh for failing to process a home loan subsidy application in time, resulting in the borrower being denied the subsidy.

A resident of Adalaj, Rina Kanpariya, took a Rs 10 lakh home loan from the bank in March 2019 and was to get a Rs 2.67 lakh subsidy on it from Housing and Urban Development Corporation (Hudco) under the Pradhan Mantri Awas Yojana. She continued to inquire about the subsidy and was told that the process was underway.

Kanpariya took the issue to the ombudsman, but got no solution to her problem. Only when she contacted Hudco, was she informed that she would not get the subsidy because the scheme had ended.

After waiting till March 2022, Kanpariya sued the bank and Hudco at the consumer commission, where the bank denied her statements. Hudco submitted that the subsidy scheme ended in March 2021, but it received the complainant’s documentsin May 2021, by when the scheme was not in existence.

Hudco also said that the complainant was not its consumer. Commission president D T Soni and member Jigar Shah concluded that liability cannot be foisted upon Hudco, but held the bank liable for a deficiency in service by not processing the complainant’s subsidy application in time. The commission directed the bank to pay the complainant Rs 2 lakh with 9% interest. It has also been ordered to pay Rs 50,000 in compensation and Rs 15,000 in legal costs.
