531 get notices for changing land use without paying fee, ET RealEstate

PUNE: The district administration has issued 531 notices to individuals for their failure to pay the transfer fee of 15%, as per the ready reckoner rate, for changing land use from industrial to residential, especially in areas like Hadapsar, Bopodi, Kothrud, Sangamwadi and Pimpri Chinchwad.

The notices have been issued as per Section 20 of the Urban Land Ceiling and Regulation Act, 1976, under which the state imposes one-time premium for regularizing land use.

District officials said after the issuance of notices, the individuals have the option of either pay the amount with penalty or face action. In the last assembly session, CM Eknath Shinde had directed the Pune district collector to initiate action against those defaulting on the payment.

“While there were about 1,000 such cases, most individuals paid up the transfer fee. We have issued notices to 531 individuals who changed the land use without paying the transfer fee,” a district official said.

The official said the industrial area has a large share of such violations and the MIDC has been provided with the names of the defaulters. “Of the 531 notices issued, 151 have been issued to landholders in the MIDC area. Hearing has been completed in 68 cases. In six cases, the sum was deposited with the state government after the hearing,” the official said.

Earlier, the state government used to charge 100% transfer fee as per the ready reckoner rates for change of land use. After opposition from citizens, 50% was introduced in 2007.

In 2019, the state government decided to levy only 15% of the ready reckoner rates as transfer fee, besides ensuring that the land got from industrial areas were put to use for affordable housing. In Pune, industrial land was converted to residential after many units shut down.

Activists said it was the responsibility of the government to keep a track of change in land use. “Citizens should not be allowed to register any sale deed without the required permissions. It is surprising that such violations are reported,” consumer activist S Joshi said.
