CHANDIGARH: Even as permission for construction of stilt plus four houses in Haryana has become a contentious issue, a recent audit by the office of accountant general (audit) has observed that floor-wise apartmentalisation in the state was permitted through executive order in contravention of the statutory provisions (Apartment Act).

As per the audit, such a move is endangering the undivided interest of an apartment owner in common facilities as well as land appurtenant to the building.

The report also revealed that Rs 307 crore collected as duty meant for expenditure on augmentation of infrastructure was not transferred to the user agencies.

The audit also highlighted that initial approval of registration of independent floors/apartments was for apartments constructed on plots having an area of more than 180 square yards, but the report found that in as many as 37 cases, independent floors were registered within the municipal area of the Faridabad district on less than 180 square yards, even on 42 square yard plots with covered area.

“Apartmentalisation in such small, plotted areas would lead to generation of high-density population clusters and needs prior augmentation of infrastructure,” the audit report said.
