Gujarat high court asks for details of impact fee appeals in towns, ET RealEstate

AHMEDABAD: The Gujarat high court on Tuesday sought information from the authority concerned on the status of applications for regularization of unauthorized constructions under the new impact fee law in the municipalities across the state.

The bench of acting Justice A J Desai and Justice Biren Vaishnav directed the deputy commissioner of municipalities to file an additional affidavit revealing details about action taken on the regularization requests.

The court issued the direction after it was informed that 13,575 regularization applications have been received by 156 municipalities in Gujarat. This happened during the hearing of a PIL taking exception to unauthorized constructions – nearly 140 residential and commercial buildings – in Dholka town.

The HC has also directed the municipality to inform the court about the status of requests pertaining to regularization of these unauthorized structures.

The court was told that out of the four builders who constructed unauthorized structures, two have applied for regularization. The court has asked the authorities to furnish information by August 9.
