2 Developers Booked For Digging Plot And Abandoning It For A Year, ET RealEstate

GHAZIABAD: The directors of Mahagun India Pvt. Ltd. and Sparsh Builder Pvt. Ltd. were booked on Wednesday following the Ghaziabad Development Authority‘s (GDA) complaint accusing the developers of digging a plot for constructing the basement of a mall and abandoning it. Due to waterlogging in the excavated pit, a road caved in, and sewer and water lines were damaged at an adjacent condo.

On July 9, a portion of the service road of Gaur Global Village Society, Crossing Republik, overlooking this pit on the mall site, caved in. A second chunk of the road gave in on Monday, and a portion of the wall of the under-construction mall had also collapsed.

“We have lodged an FIR against the directors under IPC sections 288 (negligent conduct with respect to pulling down or repairing buildings), 336 (endangering life or personal safety of others), and 427 (whoever commits mischief and thereby causes loss or damage to the amount of fifty rupees or upwards),” said a police officer.

According to a GDA official, the developer had dug up nearly 50 feet deep on the site to construct the basement of a mall and had left it like this for a year now, which is against the norms. “The developer did not make any adequate arrangements for security as per the condition of the map approved by Permit Commercial Building. The basement was left excavated without making adequate security arrangements, due to which the road caved in,” the official stated in the police complaint.

Residents of Crossing Republik also claim that the developer of Mahagun Millennia has been constructing a mall on a 7,902 sq m plot between two residential societies — Gaur Global and Mahagun Mascot — for the past several months. They alleged that the plot did not have the GDA’s approval for any commercial project.

“This land was first approved for the hospital, but then the hospital land was converted to a mall. It is an illegal map approval when the township agreement expired in 2016,” said Sanjay Jha, a resident of Crossings Republik.
